These Terms and Conditions ("Terms") govern your use of the services provided by Apex Tech Solutions Inc. DBA eRepair ] ("we," "us," or "our"), including our website, in-store services, and any related communications. By using our services, you agree to be bound by these Terms.
1. Services Provided
We provide cellphone and electronic device repair services. We will diagnose the problem with your device and provide you with an estimate for the repair. We will only perform the repair if you approve the estimate.
2. Estimates and Payment
Estimates are provided based on our initial assessment of the device. The actual cost of the repair may vary if additional issues are discovered during the repair process. We will notify you of any changes to the estimate and obtain your approval before proceeding. Approval can be provided in writing or verbally.
Payment is due upon completion of the repair.
A diagnostic fee may be charged if you decline the repair after we have diagnosed the problem. This fee covers the time and expertise involved in diagnosing the issue.
3. Data Loss
Important: You are solely responsible for backing up your data before bringing your device in for repair. We are not responsible for any data loss that may occur during the repair process.
While we take precautions to protect your data, we cannot guarantee that your data will not be lost or corrupted.
4. Warranty
We offer different types of warranty based on our repair services. The warranty covers defects in workmanship and parts used in the repair, for the duration of the warranty which is different based on the repair services.
The warranty does not cover accidental damage, misuse, liquid damage, or unauthorized modifications to the device.
The warranty is void if the device is opened or tampered with by anyone other than us.
To claim warranty service, you must return the device to us with proof of purchase.
5. Limitation of Liability
To the fullest extent permitted by applicable law, our liability for any damages arising out of or relating to our services is limited to the amount you paid for the repair.
We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or loss of use of your device.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
6. Abandoned Devices
If you fail to pick up your repaired device within 773-698-7176 days after we notify you that it is ready, we may consider the device abandoned. We will attempt to contact you via phone and email before considering a device abandoned.
We will make reasonable efforts to contact you before disposing of an abandoned device.
We may sell or otherwise dispose of abandoned devices to recoup our costs.
7. SMS/Text Messaging
We use SMS/text messaging through our point-of-sale (POS), to communicate with you regarding appointment reminders, repair updates, and, with your express consent, occasional promotional offers relevant to your device or repair history.

Consent: By providing your mobile phone number and opting in to receive SMS messages from us, you consent to receive text messages from Apex Tech Solutions Inc. DBA eRepair for the specified purposes. You may provide consent verbally

Opt-Out: You can opt out of receiving SMS messages at any time by replying "STOP" to any message you receive from us. Doing so will remove you from all SMS campaigns managed through our POS provider.

Message Frequency: Message frequency varies. You will primarily receive messages related to scheduled appointments and updates on the status of your repairs. We will send promotional messages sparingly and only to those who have explicitly opted in.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of IL without regard to its conflict of law principles.
9. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved by relevant regulations in IL

Device Selling Terms & Conditions
At eRepair, we are committed to providing a secure and seamless device selling experience. To ensure a smooth transaction, please carefully read and adhere to the following terms and conditions.
Important Note:

We do NOT purchase locked devices.

Devices must be unlocked, with all personal data and accounts (e.g., Apple ID, Google accounts) removed prior to testing.

Devices that are locked or have active iCloud accounts will NOT receive an offer, and inquiries regarding these devices will not be responded to.
For devices that are locked or found, please refer to the section below on steps you can take to handle them responsibly.
1. Acceptance of Terms
By using our automated widget on https://www.erepairchicago.com/sell , https://www.erepairchicago.com/sell-iphone-chicago , and every other widget on https://www.erepairchicago.com , you agree to these Terms and Conditions. If you do not accept these terms, please do not use the widget or proceed with selling your device to eRepair.
2. Eligibility
2.1 You must be 18 years or older to sell a device to eRepair.
2.2 You must be the rightful owner of the device, or you must have full authority to sell it. Proof of ownership may be required.
3. Device Valuation Process
3.1 The quoted price provided through our automated widget is based on the details you provide, including the device model, condition, and specifications.
3.2 The final price is subject to in-store inspection at eRepair, located at:

to verify the device’s condition and ensure it matches the information provided during the online estimate.
4. Device Testing
4.1 All devices brought to the store will undergo thorough testing to confirm functionality, including but not limited to:

Display and touchscreen functionality

Camera, speaker, microphone, and other hardware performance

Activation lock (e.g., iCloud or Google account removal).
4.2 Any issues identified during the testing process may result in a revised offer or refusal to purchase the device.
5. Locked Devices
5.1 Devices that are locked or have active accounts (e.g., iCloud or Google) cannot be purchased under any circumstances.
5.2 If you have found a locked device, here are steps you can take:

Attempt to contact the original owner using any information on the device.

Turn it in to your local law enforcement or lost-and-found service.
-
Do not attempt to unlock or bypass security features, as this may be illegal.
6. Revised Offers
6.1 If discrepancies are found between the condition stated during the online valuation and the actual condition of the device, eRepair reserves the right to provide a revised offer.
6.2 You are under no obligation to accept the revised offer. If declined, the device will be returned to you immediately.
7. Payment
7.1 Payments will be issued only after the in-store testing process is completed and the offer is accepted by you.
7.2 Payment methods include [Zelle, Venmo, Cashapp and Apple Pay].
8. Data Responsibility
8.1 You are responsible for ensuring that all personal data is removed from the device before selling. This includes performing a factory reset and removing any accounts (e.g., Apple ID, Google account).
8.2 eRepair is not liable for any data left on the device.
9. Fraud Prevention
9.1 Devices reported as stolen, blacklisted, or involved in fraudulent activity will not be purchased. eRepair reserves the right to report such devices to the appropriate authorities.
10. Liability Disclaimer
10.1 eRepair is not responsible for any damage, loss, or malfunction of the device that may occur during testing if it is due to pre-existing issues or conditions inherent to the device.
10.2 eRepair will handle all devices with care, but any device brought in for testing is done so at the seller's own risk.
11. Non-Returnable Items
11.1 Once the sale is completed, the transaction is final, and the device cannot be returned to you.
11.2 Devices left unclaimed for more than 7 days after a revised offer is declined will be considered abandoned, and eRepair reserves the right to dispose of or recycle the device.
12. Accuracy of Information
12.1 Sellers are required to provide accurate and truthful information about the device during the valuation process. Providing false or misleading information may result in disqualification from the sale and/or legal action.
13. Right to Refuse Service
13.1 eRepair reserves the right to refuse to purchase any device for any reason, including but not limited to concerns about ownership, device condition, or discrepancies in the provided information.
13.2 eRepair reserves the right to refuse service to individuals suspected of fraud, theft, or any activity that violates local, state, or federal laws.
14. Ownership Certification
14.1 By selling your device to eRepair, you certify that you are the legal owner of the device and that it is not stolen, blacklisted, or subject to any legal claims.
14.2 Any device found to be involved in illegal activity will be reported to the authorities, and no payment will be issued.
15. Confidentiality
15.1 Any personal information collected during the selling process will be handled in compliance with our Privacy Policy to protect your data and privacy.
16. Changes to Terms
eRepair reserves the right to modify these terms and conditions at any time. The latest version will always be available on our website or in-store.
